Terms of Service

By using Nosh (“Nosh”, “we”, “our”, “us”) — the iOS app, this website, and any related services (together, the “Service”) — you agree to these Terms of Service. If you do not agree, please do not use the Service.

Nosh is operated by Dirgh Shah, an individual developer. We may update these Terms; continued use after a change means you accept the revised version. The current version always lives at this page.

1. Eligibility and accounts

You must be at least 16 years old to use the Service.
Accounts are for humans. Accounts created by bots or automated means are prohibited.
Nosh uses Sign in with Apple. You are responsible for the security of the Apple ID you sign in with.
Do not share your account with anyone else.

2. Acceptable use

You agree not to:

Use the Service for any unlawful or unauthorised purpose.
Violate any applicable law, including intellectual property law.
Interfere with or disrupt the Service, its servers or its networks.
Upload or transmit malware or any destructive code.
Harass, abuse or threaten other users.
Scrape, mass-download or systematically harvest content from third-party platforms in a way that violates those platforms’ terms of service.

We may investigate suspected violations and suspend or terminate accounts involved.

3. User content and objectionable material

Nosh lets you name your maps and share them with other people. We have zero tolerance for objectionable content and abusive behaviour. You are prohibited from submitting content that is offensive, harassing, unlawful, pornographic or threatening.

We reserve the right to review, remove or block any content that violates these Terms, at our discretion and without notice. Users who repeatedly violate these policies will be suspended or permanently banned.

You can report objectionable content or an abusive user from inside the app: the … menu on any map or member, and Report this place on any place. You can also block someone, which hides everything they add from your view. Reports are reviewed and acted on within 24 hours. If you would rather email, dirghvshah@gmail.com reaches us too.

4. Content and intellectual property

Your content

You keep ownership of the map names, notes and other original content you create. You grant us a worldwide, non-exclusive, royalty-free licence to store, display and process that content solely in order to provide the Service. Personal notes and visited marks are stored on your device and are never uploaded to us.

Links you share into Nosh

When you share a link from a third-party platform — Instagram, TikTok or YouTube — Nosh does not claim ownership of that underlying third-party content. Your ability to view or share such content is subject to the terms of service of the originating platform. Nosh acts solely as a tool to organise and bookmark content available publicly or via your personal accounts.

You are responsible for ensuring you have the right to save and use any third-party content you bring into Nosh. Saving a link does not transfer ownership of the underlying material to you or to us.

Shared maps

If you share a map by link, you grant the people who join it permission to view the places on it and to see which member added each one.

Our rights

The Service, its software, design and branding are owned by us and protected by intellectual property law. You may not copy, modify, distribute, sell or lease any part of the Service without our written consent.

5. Ending your account

You may delete your account at any time from Profile → Delete account inside the app. This permanently removes your account and the places saved to your maps; it cannot be undone. Places you added to other people’s shared maps remain with those maps.

We may suspend or terminate accounts that violate these Terms.

6. Availability

The Service is provided on an “as is” and “as available” basis. We make no guarantee of uptime, availability or reliability, and we rely on third-party hosting and infrastructure providers. Analysis of a shared link depends on third-party platforms remaining reachable, which is outside our control.

7. Indemnification

You agree to defend, indemnify and hold harmless Nosh and its operator from any claims, damages, losses, liabilities, costs or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, your infringement of any third-party rights, or any content submitted through your account.

8. Disclaimer of warranties

The Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will meet your requirements, be uninterrupted or error-free, or that place information extracted from a video will be accurate. Always verify addresses and opening hours before travelling.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or exemplary damages, including lost profits, goodwill or data, arising from your use of or inability to use the Service. Our total liability shall not exceed the greater of the amount you paid for the Service in the twelve months before the claim, or US$50.

10. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in Texas.

11. General

These Terms are the entire agreement between you and us regarding the Service.
Our failure to enforce any provision is not a waiver of it.
If any provision is found invalid, the rest remains in force.
You may not assign these Terms; we may.

12. Notice regarding Apple Inc.

If you obtained the app from the Apple App Store, you also agree that:

This agreement is between you and Nosh, not Apple. Apple is not responsible for the app or its content.
Nosh alone is responsible for providing maintenance and support. Apple has no obligation to provide any maintenance or support services.
Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability, regulatory compliance or consumer protection claims.
In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation whatsoever.
You represent that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

13. Not affiliated

Nosh is not affiliated with, endorsed by, or sponsored by Meta Platforms, ByteDance or Google. Instagram, TikTok and YouTube are trademarks of their respective owners.
